Current Status of Third-Party Funding in International Arbitration, and its Development in Multiple Jurisdictions: Australia, Singapore, United Kingdom and United States

WAU’s panel on Third-Party Funding will give an update on TPF in Australia, the US, the UK and Asia, and provide an insight concerning the use and appetite for TPF in international commercial arbitration, and the type of cases that are being funded globally. The panelists will address issues such as:

- The challenges that TPF is confronting in investment arbitration and whether it could still be a viable business model considering the adversarial atmospherics against TPF coming from some States and commentators contending that the increase of investment arbitrations is partly motivated by the presence of TPF.
- The process involved in seeking financing for an international arbitration, and
- How the regulation of TPF in international arbitration might look like following the work of UNCITRAL Working Group III and the ICSID amendments?
