China’s Belt and Road Initiative: Dispute Resolution Options and Risk Mitigation

The Belt and Road Initiative (BRI), launched in 2013, is China’s central foreign policy with an emphasis on economic diplomacy and global infrastructure development projects. Since its inception, the BRI has been a flexible initiative without a centralized legal framework. This panel will explore the issues around managing the BRI’s legal, regulatory, and political risks, and if there is potential for investment treaty arbitration to also play a significant part in BRI disputes. Among others, our panelists will address the following:

- How will the BRI impact investment arbitration and the international investment regime?
- What are the dynamics of investment disputes, negotiations in particular disputes, and arbitrations with China?
- Will BRI awards be enforceable?
- Are the disputes that may arise out of BRI investment projects circumscribed to the domestic jurisdiction of the State where the projects are being developed?
- Are those disputes circumscribed to special courts or adjudication systems in China?
- Could those disputes still be submitted to investor-State arbitration? and
- Will the BRI reshape international legal norms and standards?
